Terms of Service
These terms govern your use of the KeepsYa and KeepsYa Pro software and the keepsya.com website, operated by John Kirker Inc. (“KeepsYa”, “we”, “us”).
Effective August 18, 2026
By downloading, installing, purchasing, or using KeepsYa, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the software or the site.
1. The software license
KeepsYa and KeepsYa Pro are proprietary software, Copyright © 2026 John Kirker Inc., All Rights Reserved. KeepsYa is not open source and is distributed only through keepsya.com, not the WordPress.org plugin repository. The software is licensed, not sold. Your use is governed by our End User License Agreement, summarized on the Licensing page.
Subject to these terms, we grant you a limited, non-exclusive, non-transferable license to install and use the software on WordPress sites you own or operate. You may not copy, redistribute, resell, sublicense, publish, or create derivative works of the software, reverse engineer it except as law expressly permits, or remove any proprietary notice.
2. License keys, updates, and support
The free KeepsYa plugin needs no key. A KeepsYa Pro key activates on your site and entitles you to software updates and priority support for its term. A key gates updates and support, never function: if your key lapses, the Pro software you have installed keeps working, and anything a family already paid for (credit, punch cards, packages) keeps working. Founders pricing is locked for the life of the subscription; renewals bill at the rate you purchased.
3. Purchases, billing, and refunds
- Prices are shown at checkout. Subscriptions renew automatically at the rate you purchased until cancelled; you can cancel anytime from your account.
- You are responsible for any taxes that apply to your purchase, and for keeping your billing details current.
- 30-day money-back guarantee: if KeepsYa Pro is not right for you, cancel within 30 days of purchase for a full refund, no questions asked.
- Card payments are handled by our payment processor; we do not store your full card number.
4. The AI features (bring your own key)
KeepsYa Pro’s AI features run on your own AI provider key (for example OpenAI, Anthropic, Google, or a local model). You are responsible for your AI provider’s terms and for the usage costs incurred on your key. You are responsible for how you use AI-generated content, for any notices your own site must give visitors, and for complying with applicable law. AI output may contain errors; review it before you rely on or publish it. How the AI chatbot handles data is described in our Privacy Policy.
5. Acceptable use
- Use the software lawfully and only on sites you control.
- Do not resell, redistribute, or share the software or your license key.
- Do not use the software to send unlawful, deceptive, or infringing content, or to violate the privacy or rights of others.
- Your content and your customers’ data are yours; you are the controller of the personal data you collect through the software.
6. Third-party services
KeepsYa can work alongside third-party products and services (for example The Events Calendar, payment processors, and AI providers). We are not affiliated with, endorsed by, or responsible for those third parties, and your use of them is governed by their own terms. Third-party names appear only to describe compatibility.
7. Disclaimers
THE SOFTWARE AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the software will be uninterrupted or error-free.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOHN KIRKER INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM THE SOFTWARE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless John Kirker Inc. from claims arising out of your use of the software, your content, or your violation of these terms or applicable law.
10. Termination
These terms apply while you use the software. We may suspend or terminate access for a material breach. On termination you must stop using and delete the software. Sections that by their nature should survive (license restrictions, disclaimers, liability limits) survive termination.
11. Changes
We may update these terms; the effective date above shows the latest version, and material changes will be posted here. Continued use after an update means you accept the revised terms.
12. Governing law and contact
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. [Venue and governing law to be confirmed with counsel.] Questions: contact us.
